4 Main Factors in the California Child Support Formula
These are the four most important factors in California child support calculations.
1. Number of Eligible Children
Eligible children are those under 18 or still in high school. Disabled children who need ongoing support may qualify beyond these age limits. The more children the parents share, the higher the potential support obligation.
2. Parenting Time (Timeshare)
The amount of time each parent spends with the children has a big effect on child support. The non-custodial parent typically pays support to the custodial parent. The more time the children spend in the non-custodial parent’s home, including holidays, the less support that parent may be required to pay.
3. Each Parent's Monthly Income
This factor includes income from all sources: wages, salaries, bonuses, self-employment income, investments, and more. The deductible expenses below are subtracted to calculate net income, which is the basis of child support calculations.
4. Deductible Expenses
The following expenses are typically subtracted from gross income to determine net income:
- Federal and state income taxes
- Health insurance premiums for the children
- Mandatory retirement contributions
- Mandatory union dues
- Alimony payments for other relationships
- Child support payments for other children
For complicated cases, such as when a parent owns a business, the court has discretion when calculating income and expenses for the purpose of child support orders.
Child Support and Parenting Time Examples
These examples follow two co-parents, Jamie and Taylor, to illustrate how changes in parenting time can significantly affect child support calculations.
Scenario 1: Basic Alternating Weekends — 20% Parenting Time
- Parenting schedule: Jamie and Taylor have a basic alternating weekend schedule for their two children. This means that Jamie has the children every other weekend.
- Parenting time percentage: Jamie has the children approximately 20% of the year.
- Child support estimate: Based on this parenting schedule, Jamie's estimated monthly child support payment to Taylor is $1,306.
Since Jamie has the children only 20% of the time, he pays a relatively high amount. This scenario shows how a lower percentage of time spent with children can lead to significant child support payments.
Scenario 2: Alternating Holidays Added — 25% Parenting Time
- Added holidays: To improve their co-parenting relationship, Jamie and Taylor agree to alternate major holidays with their children.
- Increased parenting time: This arrangement increases Jamie's parenting time to approximately 25% of the year.
- Reduced child support: This modest increase in parenting time lowers Jamie's estimated monthly child support payment to $1,200.Â
Compared to Scenario 1, Jamie’s child custody payments are lowered by $1,272 annually, illustrating how a relatively small increase in parenting time can have a considerable financial impact.
Scenario 3: Extended Summer Visitation — 31% Parenting Time
- Additional time: Jamie and Taylor further adjust the schedule to include four weeks of summer parenting time for Jamie.
- Further increased parenting time: Jamie's parenting time now rises to approximately 31% of the year.
- Further reduced child support: This substantial increase in Jamie's parenting time leads to a further reduction in his estimated monthly child support payment to $1,056.Â
Compared to the initial arrangement in Scenario 1, Jamie’s annual child support payments are lowered by $3,000. This highlights the considerable financial impact of extended parenting time.
Scenario 4: Equal Custody — 50% Parenting Time
- Significant schedule change: Jamie and Taylor agree to a 50/50 parenting schedule, where the children spend alternating weeks at each parent’s home.
- Equal parenting time: This arrangement results in each parent having approximately 50% of the children’s parenting time.
- Substantially reduced child support: With 50/50 parenting time, Jamie's estimated monthly child support payment is drastically reduced to $480.Â
This equal custody arrangement leads to a substantial annual reduction of $9,912 compared to the initial scenario with only alternating weekends.
Remember, these are simplified illustrations. Real-world situations tend to be much more complicated. Consult with our child support attorneys for personalized estimates of how parenting time can affect the amount of child support you pay or receive.
